While this usually involves parties who are related by blood or marriage there are many cases in which other parties are directly or indirectly involved. Family Law is more than working with highly volatile cases of dispute in a divorce. Even in a case where all parties are agreeable, simply working out the legal details and protecting everyone involved requires experienced legal assistance.

Elder Law focuses on the statutes, regulations, and issues that impact the lives of older persons and their families.  Elder law spans and encompasses elder care planning issues, such as access to the appropriate type of medical and personal care, coordinating the finance of private care, taxation, guardianship and conservatorship, general estate planning, estate and trust administration, and planning for incapacity. 


If you become incapacitated, a durable power of attorney will enable a trusted person of your choosing to make decisions for you.  Otherwise, a court proceeding may be required to have someone appointed to manage your affairs.  A health care power of attorney can anticipate and preclude the need for guardianship of the person, and a general durable power of attorney can be used to manage a person’s financial matters in lieu of a conservatorship. 


A guardian is an individual or organization appointed by a court to make personal decisions, including medical decisions and living arrangements for an incapacitated person. A conservator is an individual or organization appointed by a court to make financial decisions for incapacitated persons.  


There are several different types of Trusts.  Whether you need a Trust depends on whether you have a beneficiary with special needs, whether you have an estate beyond a certain size or whether you own property in more than one state.  However, each person’s situation must be evaluated to determine whether a Trust is an appropriate estate planning tool.
